Freedom of Information Acts (FOIA) are valuable legal tools to access information held by public authorities but during the first wave of the Covid-19 pandemic time frames to reply to requests were de jure or de facto suspended in many countries. However, the lack of effective legal tools to achieve transparency was not automatically paired with governmental secrecy. This research paper analyses which are the factors that prompted some governments to move from secrecy to transparency while the essential legal tool (...) to achieve disclosure of information was not available. It focuses on the role of ‘ecologies of transparency’, a concept developed by Seth Kreimer to describe how FOIA needs to be understood as functioning within a collection of factors and actors. Yet, can transparency ecologies still force disclosure of information when FOIA is suspended? Research focuses on a comparative case study about transparency of scientific committees advising governments on Covid-19 in the UK and in Spain. In both countries, members and minutes were initially secret, but the British government published information before being forced by FOIA, while the Spanish executive only released partial information when FOIA was reactivated. The paper argues that information disclosure processes can be understood as supply and demand models. On the demand side, it highlights the role of adversarial press, scientific community, whistle-blowers, the opposition and critics within the governing party as decisive factors within the transparency ecology. On the supply side, it focuses on legitimation needs from the government to explain different outcomes. (shrink)

Both scientific evidence and folklore have suggested that madness is associated with creativity, especially in the arts. Recently, more rigorous studies have confirmed to some extent these previous observations. The current view is that it is not severe and acute insanity that is related to heightened creativity, but the personality roots and soft manifestations of both schizophrenic and bipolar psychoses. The affective and cognitive peculiarities associated with schizotypic and hypomanic personalities may be preferentially related to different kinds of creative endeavours, (...) such as the sciences and arts, respectively. The connection between personality traits and creativity is produced because they share some biological-cognitive-personality features, such as cognitive disinhibition. Additionally, it has been shown that the genetic liability for both bipolar and schizophrenic psychoses is related to creativity. A prevailing hypothesis is that creativity may be one type of 'compensatory advantage' for those carrying the genes for psychosis. (shrink)

Research suggests that the ability to understand one’s own and others’ minds, or mentalizing, is a key factor for mental health. Most studies have focused the attention on the association between global measures of mentalizing and specific disorders. In contrast, very few studies have analyzed the association between specific mentalizing polarities and global measures of mental health. This study aimed to evaluate whether self and other polarities of mentalizing are associated with a multidimensional notion of mental health, which considers symptoms, (...) functioning, and well-being. Additionally, the level or depth of mentalizing within each polarity was also analyzed. A sample of 214 adolescents was evaluated on measures of self- and other- mentalizing, multi-informed measures of psychopathology and functioning based on Achenbach’s system, and measures of psychological well-being. Results revealed no association between mentalizing polarities and higher-order symptom factors. Self-mentalizing was associated with self-esteem and motivation to life goals, and other-mentalizing was associated to general, social and role functioning. This association between aspects of self-other mentalizing and self-other function has important implications for treatment and prevention. Deeper mentalizing within each polarity revealed stronger associations with functioning and well-being. Because mentalizing polarities are associated with functioning and well-being but not with symptoms, a new hypothesis is developed: mentalizing does not contribute to resiliency by preventing symptoms, but by helping to deal with them, thus improving functioning and well-being independently of psychopathology. These findings support that promoting mentalizing across development may improve mental health, even in non-clinical population. (shrink)

The current times call for reforms in educational processes. The Covid-19 pandemic had an unforeseen impact on the educational system in all countries. This need for change requires new pedagogies and new methods for teaching and learning. Understanding the need for change is essential for the formulation of adaptive proposals, as well as for the generation of training activities to complement the teaching curriculum. New educational practices lead to a vision of educational quality, with new approaches that allow the continuous (...) integration of knowledge and permanent interaction with the student. According to Donnellan the characteristic mark of a referential use of a definite description is the fact that it can be used to pick out an individual that does not satisfy the attributes in the description. Friends and foes of the referential/attributive distinction have equally dismissed that point as obviously wrong or as a sign that Donnellan's distinction lacks semantic import. I will argue that, on a strict semantic conception of what it is for an expression to be a genuine (...) referential device, Donnellan is right: if a use of a definite description is referential, it must be possible for it to refer to an object independently of any attributes associated with the description, including those that constitute its conventional meaning. This study examines whether character strengths predict resilience (operationalized as stable or higher mental health and subjective well-being despite an adverse event) over a period of approximately one month during the COVID-19 pandemic lockdown in Spain. Using a longitudinal design, participants (N = 348 adults) completed online measures of sociodemographic data, information regarding their situation in relation to the COVID-19, character strengths, general mental health, life satisfaction, positive affect and negative affect. All variables were measured at Time 1 and Time (...) 2, except for sociodemographic and most COVID-related information (Time 1 only). Time 1 data collection was conducted between March 21, 2020 and April 2, 2020, i.e., approximately the second week of lockdown in Spain. Time 2 data collection was conducted between April 24, 2020 and May 18, 2020, after the Spanish government announced ita intention to progressively release the lockdown. A principal component analysis of character strengths was conducted. Five character strength factors were extracted: fortitude, goodness, intellectual, interpersonal, and restraint. Factor structures at Times 1 and 2 were highly consistent. All character strength factors at Time 1 correlated positively with life satisfaction and positive affect, and negatively with negative affect and mental health at T2 (higher scores in the mental health measure indicate poorer mental health). Fortitude strengths showed the highest correlations. We conducted a series of regression analyses with strength factors at Time 1 as predictors, and mental health, life satisfaction, and positive and negative affect as dependent variables, controlling for their baseline levels. To test the directionality of the relationship between strengths and the dependent variables, all analyses were reversed. All character strength factors predicted an increase in mental health. They also predicted positive affect, with the exception of strengths of restraint. Fortitude, intellectual and interpersonal strengths predicted an increase in life satisfaction. Finally, fortitude strengths, interpersonal strengths, and strengths of restraint, predicted a decrease in negative affect. None of the reversed analyses yielded significant effects. Limitations, implications, and possible character strengths-based interventions aimed at promoting mental health in the COVID-19 pandemic are discussed. (shrink)

ABSTRACTThis article addresses the identity of the legitimate actors of international law-making from the perspective of democratic theory. It argues that both states or state-based international organisations, and civil society actors should be considered complementary legitimate actors of international law-making. Unlike previous accounts, our proposed model of representation, the Multiple Representation Model, is based on an expanded, democratic understanding of the principle of state participation: it is specifically designed to palliate the democratic deficits of more common versions of the Principle (...) of State Consent. Second, it endorses a qualified version of the Principle of Civil Society Participation, one that is much more restrictive and more critical of the democratic defects of civil society actors than most of its current supporters. In this paper we introduce a game semantics for System P, one of the most studied axiomatic systems for non-monotonic reasoning, conditional logic and belief revision. We prove soundness and completeness of the game semantics with respect to the rules of System P, and show that an inference is valid with respect to the game semantics if and only if it is valid with respect to the standard order semantics of System P. Combining these two results leads to a new (...) completeness proof for System P with respect to its order semantics. Our approach allows us to construct for every inference either a concrete proof of the inference from the rules in System P or a countermodel in the order semantics. Our results rely on the notion of a witnessing set for an inference, whose existence is a concise, necessary and sufficient condition for validity of an inferences in System P. We also introduce an infinitary variant of System P and use the game semantics to show its completeness for the restricted class of well-founded orders. (shrink)

It took a very long time before I encountered the systematic study of religious processes and dynamics as a distinctive and expansive area of scholarship. Using an autobiographical account, I trace the development of my scholarship in the social scientific study of religion. I have now experienced a great diversity of approaches to the study of religion. Driven by insatiable curiosity and knowing that no one can capture religion comprehensively, I now am committed to stimulating imaginative, rigorous, and wide-ranging developments (...) in religious scholarship. We prove completeness of preferential conditional logic with respect to convexity over finite sets of points in the Euclidean plane. A conditional is defined to be true in a finite set of points if all extreme points of the set interpreting the antecedent satisfy the consequent. Equivalently, a conditional is true if the antecedent is contained in the convex hull of the points that satisfy both the antecedent and consequent. Our result is then that every consistent formula without nested conditionals (...) is satisfiable in a model based on a finite set of points in the plane. The proof relies on a result by Richter and Rogers showing that every finite abstract convex geometry can be represented by convex polygons in the plane. (shrink)

The starting premise of this paper is that business models can transform social reality—sometimes to an extreme. Then, building on the concept of “grand challenges,” we argue that such transformations can be either positive or negative in nature —even in the case of business models designed to improve value not only economically but environmentally and socially as well. To further our understanding of the negative aspects, we introduced two conceptual categories of business model: those for oppression or depletion and exclusionary (...) ones. We further argue that bringing the notion of grand challenges center-stage highlights four elements that can contribute to emerging research and inform practice on transformational business models. These elements are: participatory forms of architecture; multivocal inscriptions; scaffolding; and proximity. They are central components of what we name transformational business models. (shrink)

Interest in republicanism as a political theory has burgeoned in recent years, but its implications for the understanding of law have remained largely unexplored. Legal Republicanism is the first book to offer a comprehensive, critical survey of the potential for creating republican accounts of fundamental issues in law and legal theory.

A central discussion in the theory of deliberative democracy in recent decades has focused on whether democratic deliberation, and consequently those participating in it, should aim, at least ideally, for political consensus. Thus, pluralist deliberative democrats have criticized the consensualist approach to deliberative democracy for neglecting the moral importance of political disagreement because of their fixation with reaching consensus. The debate between these two positions, initiated in the 1990s, has evolved in recent years toward more precision and sophistication. However, some (...) vagueness and ambiguities remain in many of the contributions and prevent us from getting an exact idea of the object of discussion. This article starts making further distinctions about several types of agreement and disagreement in order to clarify much more precisely the exact niche of dispute between these two views. They do not need to disagree on the value of many forms of disagreement and consensus. Their dispute consists only in a controversy about the relative value of post-deliberative, operative, substantive, legislative, regulatory, or adjudicative reason-based consensus as opposed to the corresponding reason-based disagreement. Finally, the article argues that this relatively small niche is made smaller by certain considerations. The most important of them is that this controversy remains at a high theoretical level and lacks practical importance: it only affects the kind of personal ideal commitment or aspiration that virtuous deliberators should have when entering into a deliberative process, and has no concrete consequent institutional implications. Noel and Amanda Sharkey have written an insightful paper on the ethical issues concerned with the development of childcare robots for infants and toddlers, discussing the possible consequences for the psychological and emotional development and wellbeing of children. The ethical issues involving the use of robots as toys, interaction partners or possible caretakers of children are discussed reviewing a wide literature on the pathology and causes of attachment disorders. The potential risks emerging from the analysis lead the authors to promote (...) a multidisciplinary debate on the current legislation to deal with future robot childcare. As a general first consideration, the questions arising from the paper are extremely timely since current robot technology is surprisingly close to achieving autonomous bonding and sustained socialization with human toddlers. The evolution of robot technology has been so speedy in the last few years that even if a discipline like Human-machine Interaction has only recently welcomed human-robot interaction within its disciplinary scope, a variety of social robots have started to populate our life and daily activities. In the past five years human-robot interaction has received a significant and growing interest leading to the development of the so-called robots companions, a term that emphasizes a constant interaction and co-operation between human beings and robotic machines. While Noel and Amanda Sharkey in their paper take a critical stance on the consequences of the use of robots as companions or caretakers, others researchers seem more keen to highlight the potential of caregiver robots in particular in educational settings. In this commentary I’ll try to offer my personal viewpoint on the consequences of using robot companions or caretakers of children on learning and education, and the effects of technologies on cognitive skills development, a controversial area of research where different findings show how little is known. In this work we examine critically how two competing approaches to meaning account for disagreements. We will argue that Hart's conventionalist stance does not commit him to descriptivism. That non-descriptivist theories of reference, properly understood, can account for a vast array of cases of interpretive disagreement and that and that an account of different kinds of disagreement can be provided from a conventionalist perspective within the framework of non-descriptivist theories of reference.

It is widely assumed that the scope of indefinites is island insensitive, i.e., that, generally, an indefinite inside of a syntactic island, such as an adjunct clause, is capable of taking scope outside of that island. This paper challenges this assumption by studying the scope behaviour of the Spanish plural indefinite algunos ’). It presents an experimental study that shows that the scope of algunos is not free and depends on its syntactic environment, at least in the dialect of Spanish (...) studied here. The paper discusses some of the implications of the study for current theories of indefinite scope: it points out the problems that choice functions and singleton indefinites have with the Spanish data, and it also discusses the implications for Schwarzschild's solution to the so-called ‘Donald Duck’ problem.
